Terms of Service

Welcome to ProofGate ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our DeFi transaction validation and security platform (the "Service"). By accessing or using ProofGate, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Acceptance of Terms
By accessing and using ProofGate, you accept and agree to be bound by the terms and provision of this agreement. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Description of Service
ProofGate is a pre-execution transaction validation service for DeFi protocols on BNB Smart Chain. Our Service:
- Analyzes DeFi transactions against configurable safety guardrails before execution
- Provides SAFE/BLOCKED verdicts with detailed security evidence and recommendations
- Helps prevent scams, hacks, infinite approvals, excessive slippage, and other DeFi risks
- Supports validation of ERC20 token approvals, DEX swaps, and smart contract interactions
- Operates as a security layer between wallets and blockchain networks
- Uses prepaid balance pools for efficient, gas-free validation requests
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. By using our Service, you represent and warrant that you meet these requirements. You are responsible for ensuring compliance with all applicable laws and regulations in your jurisdiction, including sanctions compliance and anti-money laundering requirements.
4. Non-Custodial Service
ProofGate is a non-custodial service. We never hold, control, or have access to your funds or private keys. All transactions occur directly between your wallet and blockchain networks. We only facilitate transaction validation and provide security analysis.
- You maintain full control of your wallet and funds at all times
- Validation requests are submitted off-chain through our API
- Validation results are recorded on-chain through smart contracts
- You must connect your own Web3 wallet to use the Service
5. User Responsibilities
You agree to:
- Provide accurate and complete transaction data for validation
- Use the Service only for lawful purposes and in compliance with applicable laws
- Not attempt to circumvent security measures or validation logic
- Not use the Service to validate illegal, fraudulent, or prohibited transactions
- Maintain the security of your wallet, private keys, and account credentials
- Report any security vulnerabilities or suspicious activity
- Comply with all sanctions, anti-money laundering, and regulatory requirements
6. Prohibited Activities
You may not use ProofGate to validate transactions involving:
- Illegal activities, including money laundering or terrorist financing
- Sanctions violations or dealings with prohibited persons/entities
- Market manipulation, fraud, or other prohibited financial activities
- Malicious smart contracts, malware, or harmful code
- Attempts to reverse-engineer, compromise, or disrupt the Service
- Transactions that violate the terms of underlying protocols or platforms
7. Risk Disclosures
DeFi and Smart Contract Risks
DeFi protocols and smart contracts carry inherent risks including smart contract bugs, oracle failures, impermanent loss, protocol exploits, and rug pulls. ProofGate validation provides security analysis but cannot guarantee the safety of any transaction, protocol, or smart contract. Validation results are informational and should not be considered guarantees of security.
Blockchain Network Risks
Blockchain transactions are irreversible. Network congestion, high gas fees, chain reorganizations, and technical issues may affect transaction execution and finality. ProofGate does not control or guarantee the performance, security, or availability of underlying blockchain networks.
Validation Limitations
Our validation system uses AI-powered analysis and policy-based rules but is not infallible. We may not detect all potential risks, vulnerabilities, or attack vectors. Validation results should be considered as one factor among many in your risk assessment process. You remain solely responsible for all transaction decisions.
Third-Party Dependencies
Our Service depends on third-party infrastructure including RPC providers, wallet connections, and external data sources. We are not responsible for outages, performance issues, or security vulnerabilities in these third-party services.
8. No Financial, Investment, or Legal Advice
ProofGate is not a financial advisor, investment advisor, or legal advisor. Our validation results, security analysis, and recommendations should not be construed as financial advice, investment recommendations, tax advice, or legal advice. You are solely responsible for your investment decisions, risk tolerance, and compliance with applicable laws. Always conduct your own research and consult qualified professionals before engaging in DeFi activities.
9. Fees and Payment
Prepaid Balance System
ProofGate uses a prepaid balance system. You deposit USDC or USDT directly to our liquidity pool smart contract. These funds remain under your control and can be withdrawn at any time. Fees are deducted automatically from your balance when validation results are recorded on-chain.
Fee Structure
Validation fees are based on gas fees plus our commission and may change over time. Current fees are displayed in the Service interface. You are charged for each validation request processed.
Payment Processing
All payments occur on-chain through smart contracts. You are responsible for sufficient funds in your prepaid balance and for any gas fees associated with balance deposits or withdrawals. We do not process payments off-chain and do not store payment information.
Withdrawals and Refunds
You can withdraw your unused balance from the liquidity pool at any time. Once validation fees are charged, they are not refundable as the service has been performed.
10. Intellectual Property
ProofGate and its original content, features, algorithms, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Validation policies, security rules, and analysis methodologies are proprietary. You may not reproduce, distribute, modify, reverse-engineer, or create derivative works of our Service without explicit written permission.
11. Third-Party Services
Our Service integrates with third-party services including:
- Web3 wallets (MetaMask, Trust Wallet, etc.) for user authentication and transaction signing
- BNB Smart Chain and other blockchain networks for transaction execution
- RPC providers and blockchain infrastructure for network access
- DeFi protocols and smart contracts that you choose to validate
We are not responsible for the availability, security, or performance of third-party services. Your use of third-party services is subject to their respective terms and conditions. We strongly recommend reviewing the security and terms of any third-party services you interact with.
12. Disclaimers
Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted access to our Service. The Service may be temporarily unavailable due to maintenance, technical issues, blockchain network issues, or circumstances beyond our control.
Accuracy and Completeness
While we use industry-standard security practices and AI-powered analysis, our validation system may not detect all potential risks or vulnerabilities. Validation results are provided on a best-effort basis and should not be considered comprehensive security guarantees. You should always conduct additional due diligence.
No Warranty
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
13. Limitation of Liability
To the maximum extent permitted by applicable law, ProofGate and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, cryptocurrencies, NFTs, or other intangible losses, resulting from:
- Your use of or inability to use the Service
- Any unauthorized access to or alteration of your transmissions or data
- Any statements or conduct of any third party on the Service
- Any loss or damage arising from DeFi transactions, smart contract interactions, or blockchain activities
- Any bugs, vulnerabilities, or exploits in smart contracts or protocols
- Blockchain network failures, reorganizations, or consensus issues
Our total liability for any claim arising out of or relating to these Terms or our Service shall not exceed the total amount of fees paid by you to us in the twelve months preceding the claim. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis. We do not carry insurance for user losses, and all risks associated with DeFi transactions remain the user's responsibility.
14. Indemnification
You agree to defend, indemnify, and hold harmless ProofGate and its officers, directors, employees, agents, and affiliates from and against any claims, demands, losses, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, violation of any rights of another party, or violation of any applicable laws or regulations.
15. Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms, illegal activity, or at our sole discretion. Upon termination, your right to use the Service will cease immediately, and any prepaid balances may be subject to our standard withdrawal process.
You may terminate your use of the Service at any time. Upon termination, you remain responsible for any outstanding fees or obligations incurred before termination.
16. Governing Law and Dispute Resolution
These Terms shall be interpreted and governed by the laws of the Cayman Islands, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in the Cayman Islands in accordance with the rules of the Cayman Islands International Arbitration Law.
17. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide reasonable notice of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between you and ProofGate regarding the use of the Service and supersede all prior agreements, understandings, or representations.
